Terms of Use (PassHolders)

These Terms of Use (“Terms of Use”) constitute a legally binding agreement between you (“Participating WorkSpace”) and Wanderworks Lab (“Wanderworks”). It governs your access to and use of Wanderworks’ technology platform and related products or services (“Platform”).  

By accessing or using this Platform, you agree to be bound by these Terms of Use. If you disagree with any part of these Terms of Use, please do not use this Platform. 

  1. Modification of Terms: Wanderworks reserves the right to modify these Terms of Use at any time. We will notify you of any changes by posting a notice on this Platform or by sending you an email.  
  2. User Account 
    1. To purchase passes (“Pass”) and access certain features, you may be required to create a user account. You agree to provide accurate and up-to-date information.
    2. You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorised use of your account.    
  3. Pass Purchases and Usage
    1. Each Pass can be used at any one of the designated participating cafés (“Participating Café”) and is valid for a specific duration, subject to the availability and other terms of the Platform and each Participating Café. You may purchase as many Passes as you like.
    2. Once purchased, a Pass is issued in the form of a QR code. Scan this QR code at your desired Participating Café to activate the Pass and its associated benefits.
    3. Passes are available for purchase by individuals who are at least 18 years old.
    4. Passes are non-refundable, non-cancellable and non-transferable.
    5. You agree to comply with the specific rules of the Participating Cafés, including but not limited to seating arrangement, noise levels, dress code, and business hours.
    6. Wanderworks reserves the right to terminate your access to the Platform and/or your purchased Passes at any time without notice, for any reason, including but not limited to violation of these Terms of Use. If the termination is by Wanderworks without any violation by you of these Terms of Use, you will receive a refund for the purchased Passes.
  4. Data Privacy: You agree to the collection and use of your personal information as described in our Privacy Policy. 
  5. Intellectual Property: All content on this Platform, including text, graphics, logos, images and software, is the property of Wanderworks and is protected by intellectual property laws.
  6. Liabilities and warranties
    1. This Platform and its content are provided on an “as is” and “as available” basis. Wanderworks makes no representations or warranties of any kind as to the operation of the Platform and its content. You agree that your use of the Platform is at your sole risk.
    2. You agree that any dispute in relation to your use of a Pass at any Participating Café is to be resolved between you and the Participating Café involved. Wanderworks is not liable in any manner for any claims, damages, liabilities, or expenses in relation to your use of the Passes at any Participating Café.
    3. Wanderworks is not liable for any indirect, incidental, special or consequential damages in relation to your use of this Platform or the purchased Passes.
    4. You agree to indemnify Wanderworks from any claims, damages, liabilities, or expenses in relation to your use of the Platform or violation of these Terms of Use.
  7. Miscellaneous 
    1. Wanderworks shall not be liable for any failure or delay of service if such failure or delay is caused by a force majeure event. A force majeure event means any event beyond the reasonable control of a party, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, labour strikes, government actions and pandemics.
    2. These Terms of Use shall be governed by and construed in accordance with the laws of Malaysia.
    3. Any dispute in connection with these Terms of Use shall be resolved amicably between the parties involved. If such effort is unsuccessful, parties agree to submit to the exclusive jurisdiction of the Malaysian courts.
    4. Words importing the singular include the plural and vice-versa.
